State and local authorities failed 12-year-old Pennsylvania girl who died after abuse, lawsuit says

PHILADELPHIA– The state, two counties and several schools missed warning signs and failed to protect a 12-year-old Pennsylvania girl who was abused at home before she died in May, according to lawsuits filed Wednesday by the girl’s family.

Malinda Hoagland’s half-sisters filed suit in both Pennsylvania state court and federal court, claiming the defendants negligently overlooked warning signs, such as the fact that Malinda’s father’s girlfriend, who helped care for the girl, had previously been convicted of child abuse.

Malinda’s father, Rendell Hoagland, and wife, Cindy Warren, are charged with murder and other charges stemming from Malinda’s death in May in Chester County, a suburb of Philadelphia. Attorneys for the two are not listed.

“With these civil lawsuits, we seek to ensure that the educators, social workers and institutions that miserably failed Malinda are held fully accountable for their heinous actions,” the half-sisters’ attorney, Tom Bosworth, said in a statement.

The lawsuit describes tragic treatment, including being chained to an air hockey table, not being given food, being forced to hold books over her head and do push-ups. She was regularly verbally abused and her bruises were covered up, the lawsuit says.

Chester County prosecutors arrested Rendell Hoagland and Warren after they reported Malinda unresponsive in May. She was taken to the hospital, where staff found she had broken bones and bruising all over her body, prosecutors said.

The federal court complaint names the state and Chester and Monroe counties, as well as the Upper Dublin and Coatesville Area school districts. The state’s complaint names Commonwealth Charter Academy. Messages were left with the defendants seeking comment.

The state’s attorney general’s office said in an email that it was reviewing the lawsuit and would not comment. Chester County declined to comment. A Monroe County official said questions had been referred to another official.
