Bismarck man charged with sex crimes against 10-year-old girl

A 24-year-old man was arrested early Thursday on the grounds of the State Capitol in Bismarck. He is accused of having illegal sexual relations with an underage girl.

According to a statement from Bismarck police, officers arrived at the scene shortly before 6 a.m. after a 10-year-old girl was not home and reported to a family member via Snapchat that she had been sexually assaulted.

When they arrived, they found the man, named Isiah Simms, and the girl, the statement said. Investigators determined that sexual assault had occurred, and Simms was arrested and booked into the Burleigh Morton Detention Center, police said.

Simms is charged with four counts of sexual abuse of a minor under the age of 15. Each count carries a maximum sentence of life in prison without the possibility of parole. Each count also carries a mandatory minimum sentence of five years.

Bail in Simms’ case is set at $250,000 cash. Court records do not indicate he is represented by an attorney.

According to court records, Simms has no criminal history in North Dakota, but police spokesman Lt. Luke Gardner told the Tribune that Simms is believed to be from Minnesota.

A search of Minnesota court records revealed that Simms had previous misdemeanor convictions in Hennepin and Washington counties in 2017 and 2019. None of those cases were related to illicit sexual activity.

Simms’ next appearance on the Burleigh County charges will be a preliminary hearing scheduled for September 23.
