Floor vomit subject of lawsuit over health building in Surrey

The lawsuit mentions numerous injuries. The operators of the building failed to ensure that “there was no vomit on the grounds.”

A health care facility in Surrey is facing legal action by a person who claims he slipped on vomit on the property’s grounds and injured himself.

Kamni Krishna Murti’s civil lawsuit, filed by the Preszler law firm in the Supreme Court of British Columbia on August 14, alleged, among other things, that the owners of the building at 13737 96th Ave. failed to ensure that “there was no vomit on the floor of the premises.”

Murti claimed that they fell on January 5, 2023 due to vomit on the floor.

The building is located opposite the Surrey Memorial Hospital.

An online search shows the address to be City Centre 1 Office Tower. The website is down, making it difficult to contact them for comment.

The lawsuit further alleges that the owners knew or should have known that vomit on the floor would and did create a hazardous situation. Court documents state that the owners allowed vomit to accumulate on the floor and did not remove it.

The lawsuit states that the area is heavily trafficked and that those in charge of building management failed to warn of the risk of vomiting.

The claim identifies the strata corporation only by its number and the property management or maintenance companies no differently than ABC Property Management Company and XYZ Maintenance Company.

The lawsuit alleges multiple injuries as well as dizziness, nausea, emotional distress, chronic pain and fatigue.

Murti is demanding multiple compensation for negligence and breach of duty.

None of the allegations have been proven in court.
