Kolkata rape and murder: Chief Justice DY Chandrachud points to long shifts of doctors, top quotes from Supreme Court hearing

The Supreme Court on Thursday resumed hearings into the brutal rape and murder of a 31-year-old PhD student at RG Kar Medical College and Hospital in Kolkata. During the hearing, Chief Justice of India DY Chandrachud refuted the theory that “151 grams of semen” was found in the victim’s body and rebuked the Central Bureau of Investigation (CBI) lawyer, saying that social media cannot be relied upon to argue the case in court.

The Chief Justice also called on the protesting doctors to return to work and assured them that no action would be taken against them.

The three-judge bench, headed by the CJI, also includes Justices JB Pardiwala and Manoj Misra.

In its status report to the Supreme Court, the CBI stated that the The crime scene was altered and the victim’s family was misled about their daughter’s death, claiming it was suicide.

Furthermore, the federal agency said its investigation so far points to the involvement of one person: accused Sanjoy Roy, who was arrested in connection with the case, India Today has exclusively learnt.

Roy, a volunteer with the Kolkata Police, was arrested a day after the half-naked body of the trainee doctor was found in the seminar hall of RG Kar Hospital on August 9.

HERE ARE THE TOP QUOTES FROM THE SUPREME COURT:

1. “We have the actual autopsy report in front of us and know what the 150 g refers to. Please do not use social media for your arguments.”

2. “Let them all return to work. We will issue a general order. Rest assured that once the doctors return to work, we will make the authorities not take any contrary measures. How will the public administration function if they do not return to work?”

3. “The committee (National Task Force) will ensure that it hears all representatives. We will reiterate this in our order… Our sympathy goes out to all those who go to public hospitals. We will make a statement that the junior doctors will be heard because your commitment and contributions are very high.”

4. “If we start asking representatives of different stakeholders to be part of the committee, the work of the committee will be disrupted… We know that the committee includes senior women doctors and they have dedicated their lives to public health infrastructure… The committee will listen to everyone… interns, residents, senior doctors, nurses, paramedical staff… The committee will ensure that all representatives are heard.”

5. “Please reassure doctors that we know they are working 36 hours… I myself slept on the floor of a public hospital when one of my family members was unwell.”

6. “The shift lasts just under 48 hours, and then you are neither physically nor mentally able to defend yourself if someone annoys you. I don’t even want to talk about serious crimes.”

7. “(Kapil) Sibal, one aspect is extremely disturbing, the death entry in the GD (General Diary) was recorded at 10:10 am… the securing of the crime scene, seizures etc. were carried out at 11:30 pm at night? What had happened till then?”

8. “The entire procedure followed by your state is something I have never seen in the 30 years of my life. First, is it true that the UD (unnatural death) was registered at 10.30 am (10:30 p.m.)? Second, who is this deputy chief non-medical officer? Her conduct is also very dubious. Why did she act in this manner?”

9. “Please ensure that a responsible police officer is present here. We have not received any response yet as to when the UD case was registered.”

10. “If the report shows that the recording was made after returning to the police station and after handing over the body to the mother, if the police say that GD 861 was recorded at night, then how can the UD before that be referred to in the investigation report?”
