Controversy over Jordan Chile’s Olympic floor exercise continues USA claims CAS sent emails to wrong addresses

The Court of Arbitration for Sport (CAS) has confirmed its decision that Romanian Ana Barbosu deserved third place in the floor exercise at the Olympic Games in Paris.

This decision prompted the International Olympic Committee (IOS) to ask American gymnast Jordan Chiles to return the bronze medal originally awarded to him.

According to CNN partner broadcaster Antena 3, a video emerged on Friday showing Barbosu being awarded the bronze medal at an official ceremony at the Olympic Sports Federation in Bucharest. The ceremony took place in front of the Romanian Olympic Committee and was attended by the President of the Romanian Olympic and Sports Committee Mihai Covaliu and Romanian Prime Minister Marcel Ciolacu.

In a press release on Wednesday, CAS stated that during the hearings with Romanian and US officials, there was never any dispute over USA Gymnastics (USAG) missing a one-minute deadline to challenge Chile’s floor exercise score.

The Olympic judges had already revised Chile’s score and awarded her the bronze medal, but pushed Barbosu off the podium.

During the hearing, there was no dispute between the parties that Ms Chiles’s investigation was filed 1 minute and 4 seconds after her score was officially displayed on the scoreboard, CAS said in its press release.

All parties considered the report prepared by OMEGA, the Official Timekeeper of the Olympic Games, and submitted by the FIG to be clear and conclusive. No other evidence was admissible.

USAG had previously stated that it had not received any video proving that its investigation was filed just 47 seconds after the CAS decision.

The video footage provided to USA Gymnastics prior to the tribunal’s decision was not available and therefore USAG had no opportunity to provide it earlier, USAG said Sunday.

The United States Olympic and Paralympic Committee (USOPC) and USAG also claimed that the CAS initially sent important communications to the wrong email addresses, which is why the parties were unable to adequately prepare for the hearing.

The USOPC strongly disagrees with the CAS decision due to significant procedural errors, the USOPC told CNN on Thursday. From August 6 to August 9, the CAS sent important communications to the wrong USOPC and USAG email addresses. One error was not corrected until August 9 – three days after the filing, two days after the deadline to file objections and less than 24 hours before the hearing.

This did not give us enough time to provide a meaningful response or gather the necessary evidence. We immediately submitted our objections to CAS.

Both sides say they will continue to pursue the case.

“Our search for the truth in this case remains relentless,” the USOPC said.

Chiles said on Instagram on Thursday that she was overwhelmed by the outpouring of love and support following the incident.

I am so grateful for the unwavering support of my family, teammates, coaches, USAG and USOPC fans during this difficult time.

I am at a loss for words. This decision feels unfair and is a huge blow not only for me but for everyone who has been part of my journey, Chiles added. “I have put my heart and soul into this sport and I am very proud to represent my culture and my country.”

I will face this challenge like any other – and do everything possible to ensure justice is done.

On Monday, USAG said it would continue to pursue all possible means and appeals, including the Swiss Federal Court, to ensure fair scoring and medal awarding for Jordan.

The National Arbitration Council has also raised concerns about Dr. Hamid G. Gharavi, who has represented Romania in previous arbitrations and chairs the CAS panel. According to CAS, neither side objected to Gharavi’s appointment to the panel, but USAG claims it was never informed of his ties to Romania.

CAS has not provided USA Gymnastics with any information regarding panelists’ conflicts of interest, nor have we seen any information to date, the statement said.

Barbosu said on Friday: “The solution to this case was possible thanks to the federation and the law firm, who did not lose faith in us players, fought for all of us and wanted us to have three bronze medals in our account.”
